SA: High Court refuses Grosser leave to appeal

ADELAIDE, Aug 15 AAP - The High Court has refused an application for special leaveto appeal from an Adelaide man twice found guilty of the attempted murder of a policeman.

In the case of Tony Grosser, 48, the court today found he was premature in his applicationand should first take his case to South Australia's Court of Criminal Appeal.

Grosser represented himself as he did in his second trial in the SA Supreme Court,which ended with a guilty verdict in June this year.

The trial lasted more than 10 months, one of the longest in SA history.

He was also found guilty at his first trial in 1996 but the verdict was overturned on appeal.

In the second trial Grosser conducted his own defence after the judge refused to stayproceedings following Grosser's decision to dismiss his lawyer.

Grosser told the High Court, sitting in Adelaide, that the judge erred in not delaying the trial.

But the court ruled that while that might or might not be the case, Grosser must firstargue his point before the appeal court.

Grosser's case involved the near fatal shooting of Senior Constable Derrick McManusin 1994 who suffered at least six wounds from a semi-automatic rifle during a siege inthe Barossa Valley.

Constable McManus and other officers had gone to Grosser's house after he failed toattend court to face fraud charges.

Grosser is awaiting sentence on the attempted murder charge.
